Terms of Service

These terms govern use of the Vyvir website and the Vyvir platform.

Last updated: 12 September 2026

These terms govern use of the Vyvir website and the Vyvir platform. By creating an account or using the service, you agree to them. Please read them.

Vyvir is operated by Woyono Limited, a company registered in England and Wales under company number 17334114, registered office in Manchester.

1. Who may use Vyvir

You may use Vyvir if you are an institution, an educator or a learner authorised to hold an account, and if you have the legal capacity to accept these terms. Where an institution provides your account, that institution’s own policies apply alongside these terms.

Accounts for learners below the age set by your local law require appropriate institutional or parental authorisation. The institution or educator issuing the account is responsible for obtaining it.

2. Accounts

You are responsible for the accuracy of your account details, for keeping your login credentials secure and for activity carried out under your account. Tell us promptly if you believe your account has been accessed without your permission.

You may hold relationships with more than one institution or educator through a single Vyvir identity. Those relationships remain separate, and one organisation cannot access another’s records.

3. What Vyvir does and does not do

Vyvir provides structured questioning, evidence gathering and review tools that support academic assessment.

Vyvir does not make academic decisions. Evidence indicators produced by the platform are not grades, outcomes or findings of misconduct. The authorised educator or institution makes every academic judgement, and remains responsible for it.

Vyvir does not determine authorship, detect plagiarism, detect AI-generated content or establish misconduct.

4. Institutional responsibility

Where an institution or educator uses Vyvir to assess learners, that institution or educator is responsible for:

  • the lawfulness and fairness of its assessment practice
  • notifying learners of assessment conditions
  • obtaining any consents its own law and policy require
  • applying its academic integrity, appeals and reasonable adjustment procedures
  • the accuracy of information it enters into the platform
  • the decisions it records

5. Acceptable use

You agree not to:

  • use Vyvir unlawfully or for any purpose other than legitimate education and assessment
  • attempt to gain unauthorised access to any account, workspace or data
  • interfere with, disrupt or attempt to circumvent the platform's assessment, integrity or security controls
  • impersonate another person in an assessment, or assist anybody in doing so
  • upload material you have no right to upload
  • extract, copy or resell the platform or its content
  • use the platform to harass, discriminate against or harm any person

Breach of this section may result in suspension or termination, and where relevant, referral to your institution.

6. Content and intellectual property

You keep ownership of the work, questions, materials and responses you and your learners create. You grant us the limited licence we need to operate the service for you: to process, store, display and transmit that content as the service requires.

Vyvir, its software, branding, designs and documentation remain our property. Nothing in these terms transfers any of it to you.

7. Subscriptions, fees and trials

Charges, billing periods and renewal terms are set out in your order or subscription plan. Fees are payable in advance unless agreed otherwise. Unless your plan says otherwise, subscriptions renew automatically and may be cancelled before the renewal date.

Free tiers and trials may carry usage limits and may be changed or withdrawn.

Paying for Vyvir funds access to the service. It never creates academic authorisation, and it never influences an academic outcome.

8. Availability and changes

We work to keep Vyvir available and reliable, and we will give reasonable notice of planned maintenance that affects assessment periods where we can.

We may add, change or remove features. Where a change materially reduces a feature you rely on, we will give you reasonable notice.

9. Suspension and termination

You may close your account at any time. Institutions and educators may end a subscription under the terms of their plan.

We may suspend or terminate access where these terms are breached, where required by law, or where continued access poses a risk to the platform or its users.

On termination, we handle your data in line with the Privacy Policy and any retention terms agreed with your institution.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of data beyond our stated retention commitments, or for academic decisions made by an institution or educator. Our total liability in any twelve month period is limited to the fees paid for the service in that period.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you hold in your country of residence.

12. Changes to these terms

We may update these terms. Where a change is material, we will give notice before it takes effect. Continued use after that date means you accept the revised terms.
